2023 3-Hour Spring Seminar | Lessons to be Learned From Disabled Access Litigation (In-Person)

PRESENTATION OVERVIEW:

The CASI spring seminar will review the lessons to be learned from disabled access litigation in state and federal courts.  The subjects of the seminar will include how to determine and apply the applicable standard when conducting a disabled access evaluation and the importance of identifying the correct standard in litigation, the plaintiff’s burden of proof that a proposed alteration is readily achievable, applying the California Historic Building Code in litigation, the limits on a jurisdiction’s authority to interpret the building code and/or grant exemptions and other court decisions interpreting and applying the ADA and Title 24 disabled access requirements.

LEARNING OBJECTIVES 

Participants will be able to:

  1. Understand how to determine and apply the applicable standard when conducting a disabled access compliance evaluation and the importance of applying the correct standard in litigation.
  2. Be familiar with the recent court ruling establishing the burden of proof for a plaintiff alleging a particular remediation is readily achievable.
  3. Be aware of the court rulings applying the California Historic Building Code and the steps necessary to use the Code as a defense in litigation.
  4. Be aware of court rulings limiting the discretion of jurisdictions to excuse compliance with Title 24 requirements.
  5. Be familiar with other court decisions interpreting and applying the ADA and title 24 disabled access requirements.

Cris Vaughan, Esq, CASp, ADAC, PA

Cris Vaughan is admitted to practice law in California and Nevada, as well as various federal district courts, the Ninth Circuit Court of Appeals, and the United States Supreme Court. He has been attorney of record in more than 1,000 disabled access litigation cases in both state and federal court. He is a certified accessibility specialist who assists businesses in complying with state and federal accessibility laws, thus avoiding or limiting the expense of litigation or damage claims. He has lectured and taught seminars to business and professional groups throughout California on a wide range of ADA issues and access compliance. He has also represented a number of public entities and served as a deputy county counsel where he litigated civil rights, employment and personnel matters.
