Join us for a comprehensive webinar led by accessibility expert, Jim Terry, designed to clarify some of the most commonly misunderstood and misapplied concepts in the ADA and other accessibility standards across the United States. Participants will learn how to correctly apply these key concepts, terms, and exceptions in real-world scenarios through engaging discussions and practical examples from across the country, including California.

LEARNING OBJECTIVES

Participants will be able to:

  1. determine if an alternative design, product, or technology provides Equivalent Facilitation and how to document that decision.
  2. determine whether an element is eligible for the Safe Harbor exception under the 2010 ADA regulations and the CBC and specifically when that safe harbor applies in each.
  3. learn the very limited proper application of the Structurally Impracticable exception under the ADA.
  4. understand all of the main exceptions that serve as the basis for deciding that an existing condition makes full compliance with the standards’ concept of Technically Infeasible. They’ll also learn how to decide what can be done to alter the element To the Maximum Extent Feasible.
  5. understand all of the key obligations and exceptions affecting the determination of what is Readily Achievable for barrier removal in an existing place of public accommodation. They’ll understand who can help to inform that decision and who has enough information (and the obligation) to actually make the decision.
  6. recognize “programs” and how to provide access to them so that, when viewed in their entirety, they comply with the Rehab Act and the ADA Title II regulations.
  7. understand the process and the players who have to participate in the proper application of the Historic Exceptions for accessibility in qualified historic facilities. They’ll also understand the use of alternative methods of providing access in historic facilities through reviewing and discussing examples.
  8. understand how movable elements such as furniture and equipment are covered by both the ADA Standards and the regulations, and how to determine what is necessary for them to be compliant.

    James L. E. Terry, AIA, APAC-BE, CASp is the CEO of Evan Terry Associates. He joined the firm after receiving his B.S. in Architecture from the University of Southern California and his Master of Architecture degree from the University of Michigan in 1977. Since July 27, 1990, he has led ETA’s team focused on accessible design and in particular the Americans with Disabilities Act and various state and other accessibility standards’ requirements. In 2015, he and Evan Terry Associates launched Corada.com, the Comprehensive Resource for the ADA as a free service for ADA professionals and others. Corada now has over 150,000 distinct users annually. He serves on the Board of Directors of the National Association of ADA Coordinators and the national expansion committee of the Accessibility Professionals Association and their APAC-BE certification exam SME team. He has presented hundreds of seminars and webinars on ADA and access compliance topics nationwide. Over the years, Jim and his team have served a broad variety of client types including hundreds of private entities, universities, federal agencies, plus state and local public entities.
